Tony Pace, a Black man and Mary Cox, a White woman were convicted under Alabama’s criminal code outlawing “fornication” and “adultery” between persons of different races. They were sentenced to two years of prison and subsequently sued the state. On January 29, 1883, in Pace v. Alabama, the US Supreme Court unanimously upheld the convictions, calling miscegenation statutes non-discriminatory and not in violation of the 14th Amendment.
